Most claims are settled out of court, usually after a significant amount of effort has been expended to build the client's case in the discovery and motion stage of the litigation, by investigating the cause of the accident to evaluate causation and fault issues, developing a clear understanding of the client's medical condition by obtaining and interpreting medical records and sending clients to specialists to fully evaluate the client's condition and records and diagnose the degree of permanency of the client's injuries.

Mr. DeBottis advises his personal injury clients of his recommendations with respect to each settlement offer made and of the pros and cons of proceeding to trial under the particular facts of each client's case.

Mr. DeBottis knows how to present cases to insurance carriers and their defense counsel. If the client elects to proceed to trial, he will be prepared to advocate the case aggressively.

Legal fees and expenses: In personal injury matters, legal services are charged on a contingency fee basis. This means that clients do not pay anything for legal services unless and until we recover a settlement or verdict in the client's favor. Typically, the contingency fee is one-third of the net recovery, after deducting expenses and disbursements incurred on the client's behalf during the course of the case.
